HOSTNEY, LLC ("Company") has established the following policy regarding copyright infringement in compliance with the Digital Millennium Copyright Act (DMCA).
Procedure for Reporting Copyright Infringement
HOSTNEY responds to copyright notifications submitted under the DMCA. Section 512 of the DMCA specifies the statutory requirements for reporting copyright infringement and includes instructions on how affected parties can submit a counter-notice to appeal a removal.
If you believe that material or content hosted on or accessible through HOSTNEY's services infringes your copyright, please send a notice of copyright infringement containing the following information to the Designated Agent listed below:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner who claims infringement.
- Identification of the copyrighted works or materials being infringed, including the URL or IP address of the link where the material is located, as well as the reference or link to the infringing material or activity to be removed or disabled. Provide sufficient information to allow us to locate the reference or link, including the URL or IP address, if applicable.
- Contact information of the notifier, including address, telephone number, and, if available, email address.
- Include the following statement in the body of the notice: "I hereby state that I have a good faith belief that the disputed use of the copyrighted material or reference/link to such material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."
- Include the following statement in the body of the notice, made under penalty of perjury: "I hereby state that the information in this notice is accurate and, under penalty of perjury, that I am the owner or authorized to act on behalf of the owner of the copyright or of an exclusive right under the copyright that is allegedly infringed."
Consequences of Sending A DMCA Notice
The Company will carefully review your notice to ensure its accuracy, validity, and completeness. If it meets these requirements, we will forward the notice to the customer or user associated with the alleged infringing material. In the event that the person responsible for the material believes the notice to be incorrect or that they have the right to use the material, they may submit a counter-notice as permitted under Section 512(g)(3) of the DMCA.
Please note that under 17 U.S.C. § 512(f), you may be held responsible for any damages, including costs and attorney's fees incurred by us or our users, if you knowingly provide false or misleading information regarding infringement. Therefore, before submitting a DMCA notice, ensure that you are the rightful copyright holder (or authorized to act on behalf of the owner), hold a good-faith belief that the identified material is genuinely infringing, and understand the consequences of making a false claim.
Whom to contact about DMCA issues?
In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. 512(c)), all reports of copyright infringement concerning websites hosted by HOSTNEY should be exclusively directed to its designated agent.
